1. Acceptance

By downloading, installing, or using Mello, you confirm that you have read, understood, and agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

Mello is intended for users aged 18 and older. By creating an account, you confirm that you are at least 18 years old. We reserve the right to terminate accounts of users who do not meet this requirement.

3. Description of the service

Mello is a companion app for people on GLP-1 medications (such as Ozempic, Wegovy, Mounjaro, and Zepbound). It provides tools for AI-powered food scanning, dose and injection tracking, side-effect logging, weight and progress tracking, and hydration monitoring. The app is available on iOS and Android. Features may change over time.

4. Not medical advice

Mello is a wellness tracking tool, not a medical device. The nutritional estimates, scores, and insights provided are for informational purposes only. They are not a substitute for advice from a doctor, dietitian, or other licensed healthcare provider. Do not use Mello to diagnose or treat any medical condition. Emplica accepts no liability for health decisions made based on information from the app.

5. Accounts and responsibilities

• You are responsible for keeping your login credentials secure.
• You must not share your account with other people.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at [email protected] if you suspect unauthorised access.
• You must provide accurate information when creating your account.

You agree not to:

• Use Mello for any unlawful purpose.
• Attempt to reverse engineer, decompile, or otherwise extract the source code of the app.
• Scrape, harvest, or systematically collect data from the app.
• Upload content that is false, harmful, abusive, or violates third-party rights.
• Interfere with the operation or security of the service.

8. Intellectual property

All content in Mello, including the name "Mello", the Mello mascot, the Emplica brand, the app design, and all underlying technology, is owned by Emplica or its licensors. Nothing in these terms grants you any ownership rights. You may use the app for personal, non-commercial purposes only.

9. User content

You retain ownership of any content you create in the app, including food photos, health logs, and progress photos. By using the food scan feature, you grant us a temporary licence to send your photo to Google Gemini for analysis. We do not claim ownership of your personal health data and we do not sell it. You can export or delete your data at any time from within the app.

10. Disclaimers and limitation of liability

Mello is provided "as is" without warranties of any kind. We do not guarantee that the app will be error-free, uninterrupted, or that nutritional estimates will be perfectly accurate. To the fullest extent permitted by law, Emplica will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

You may stop using Mello at any time and delete your account from within the app. We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the app ceases immediately.

12. Governing law

These terms are governed by applicable law. Any disputes shall be resolved through negotiation in good faith. If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of the jurisdiction in which Emplica operates.

13. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you via the app or by email. Continued use of the app after changes take effect constitutes acceptance of the updated terms.
